Terms of Use

• You must be 18 or older and have full legal capacity. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these terms.
• You must give accurate information, keep your sign-in details confidential, and you are responsible for all activity under your account. Tell us immediately about any unauthorised use.

Samar provides AI text-to-speech in Arabic and Saudi dialects, and a Content feature that creates animated videos with voice, music and sound effects. We may develop, change or discontinue features. Features marked "New" or "Beta" are provided as they are and may change.

AI output can contain errors of pronunciation or meaning; you are responsible for reviewing it before publishing or relying on it.

• Prices are in Saudi riyals and include VAT (15%); we issue a tax invoice for every payment.
• Each plan gives you a character allowance and features for its period. Unused allowance doesn't carry over to the next period.
• Subscriptions don't renew automatically; you renew yourself when a period ends.
• The free plan is limited and for personal, non-commercial use.
• We announce price changes before they take effect; they don't affect a period you've already paid for.

Under the E-Commerce Law, you may cancel a paid subscription and receive a full refund within seven (7) days of payment, provided you haven't started using the paid features (such as using characters or exporting videos beyond the free plan's limits). Once you've started using them with your consent, performance of the Service has begun and the payment is non-refundable, unless we fail to provide the Service or the law provides otherwise.

Refunds go back to the original payment method. To request one, email info@mobisense.ai.

• You keep the rights to the texts and materials you submit, and grant us a limited licence to process them only as needed to provide the Service.
• As long as you follow these terms, you may use the audio and video files you create according to your plan: the free plan for personal, non-commercial use, and paid plans for commercial use within the limits shown for each plan on the pricing page.
• Music and sound effects generated in the Content feature are licensed only for use within the video they were created in. You may not extract or distribute them on their own, compile them into a library, or use them in television, radio or film without our written agreement.
• The voices themselves aren't yours: you may use the output, not the voices. You may not use output to clone voices or to train AI models.
• By the nature of AI, different users may receive similar output; we don't guarantee that output is unique.

You may not use the Service to:

• Impersonate any real person or imitate their voice or likeness without their explicit, documented consent, or create fake content intended to mislead.
• Commit fraud or phishing, send unsolicited calls or messages, or do anything else prohibited by the Anti-Cyber Crime Law.
• Create content that offends Islam or other religions, harms the State, its symbols, public order or public morals, incites hatred, violence or terrorism, or that is defamatory, abusive, pornographic or harmful to children.
• Impersonate a government entity or official, or spread misinformation or rumours.
• Infringe intellectual property or privacy rights, or submit other people's personal data without a lawful basis.
• Attempt to breach, disrupt or circumvent the limits of the Service, scrape it, or resell access to it without written permission.

You must clearly disclose that content is AI-generated wherever not doing so could mislead the audience. We may remove violating content, suspend or close accounts, and report to the competent authorities.

The Service relies on technology from third-party providers (such as ElevenLabs). Our technology providers are third-party beneficiaries of the provisions of these terms that relate to the use of their technology (acceptable use, output limits, disclaimers and limitation of liability) and may rely on them.

The platform, its software and design, the Samar brand and its voices belong to us or our licensors. These terms give you no rights in them beyond using the Service as described here. If you send us feedback or suggestions, we may use them without obligation to you.

The Service is provided "as is" and "as available" to the extent the law permits; we don't guarantee it will be uninterrupted or error-free.

To the extent the law permits, we are not liable for indirect or consequential damages or loss of profit, and our total liability for any claim will not exceed the amounts you paid us in the three months before the claim. This doesn't limit our liability for fraud, gross negligence, or anything that can't be limited by law.

You are responsible for the content you submit and publish, and you will indemnify us against any claim arising from your breach of these terms or the law.

You may stop using the Service and ask us to delete your account at any time. We may suspend or close your account if you breach these terms or the law, or if a legal order requires it. After termination your data is handled according to the Privacy Policy.

We may change these terms. We will notify you at least fifteen (15) days before any material change takes effect. Continuing to use the Service after it takes effect means you accept it.

These terms are governed by the laws of the Kingdom of Saudi Arabia. We will try to resolve any dispute amicably within thirty (30) days of you notifying us at info@mobisense.ai; if that fails, the competent judicial authorities in the Kingdom of Saudi Arabia have jurisdiction, without prejudice to your right to complain to the Ministry of Commerce.
